If there's one thing my Copyright Law professor taught me, it's that unauthorized samples on Mixtapes - although not typically litigated as often in the hip hop world as one might think considering how much unauthorized sample occurs in the genre - is still a violation of the copyright holder's 1) reproduction rights, 2) derivative rights, 3) distribution rights.... that being said, copyright law (to a degree) is an archaic legal structure that has failed to transform itself in tune with the modern times/culture.. #K.I.D.S.
